The prosecution's claim that security officer Mabunda would be a 'hostile witness' has spectacularly backfired in Julius Malema's firearm trial. Court revelations show Mabunda voluntarily surrendered the disputed firearm and provided SAA flight tickets proving the weapon couldn't have been in East London.
'Here's my ticket - SAA doesn't allow rifles,' Mabunda reportedly told investigators, providing documentary evidence that the firearm remained in Johannesburg. Malema's legal team has framed this as proof of 'political persecution rather than legitimate prosecution.'
Legal analysts highlight the unusual situation where a witness the state labeled as potentially hostile actually provided evidence supporting the defense. 'This demonstrates either prosecutorial incompetence or bad faith,' said constitutional law professor Thandeka Nkosi.
The trial's developments may influence future high-profile cases, particularly regarding how prosecutors assess witness reliability and present alternative theories of evidence tampering without forensic proof.
